D4 Surgicals India Pvt limited (Directors) and the Franchisee agent at all times is not responsible or liable for any damage occasioned to the product either on account of improper or negligent conduct on the part of the customer, its servants or agents for any reason whatsoever. Further the Franchiser and the Franchisee agent will not be liable for loss or damage due to delay in service resulting from any cause beyond its reasonable control, including, but not limited to, compliance with any regulations, orders or instructions of any federal, provincial or municipal government or any department or agency thereof, acts or omissions of the Franchisee, acts of civil or military authority, fires, strikes, lockouts, embargoes, and delays in transportation. However, in no event shall the Franchisor and the Franchisee agent be liable for any financial loss, including consequential or special damages on account of delay due to any cause. The Franchisee agent shall disclose the above clause to the customer before selling the products to the customer.

In any event of unfortunate accident resulting into temporary, partial or total disablement or death or other natural calamities caused due to lack of care or negligent on the part of the customer, their servants or agents, the Franchiser nor the Franchisee agent shall be liable for any loss or damage arising from such negligent act of the purchaser/customer. The Customer/purchaser are fully responsible for any such incident occurred to them as stated above due to their negligent or failure to take care of the product as the prudent person can take with precaution.
